Agreement to Terms

By accessing or using TruckCmd services (TruckSched, TruckInvy, and Food Truck Fav), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users, including food truck operators, venue organizers, and customers who discover trucks via Food Truck Fav.

Eligibility

To use TruckCmd, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the authority to enter into this agreement on behalf of your business, if applicable
• Provide accurate and complete registration information
• Not be prohibited from using the service under applicable law

Account Responsibilities

When you create a TruckCmd account, you agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Take responsibility for all activity that occurs under your account
• Provide accurate business information (truck name, contact details, schedule data)
• Not share your account with others or create multiple accounts

Acceptable Use

You may use TruckCmd to:

• Manage event scheduling and approvals for your food truck business
• Generate prep lists and track inventory
• Publish your schedule so customers can find you

You may not:

• Use the service for any illegal purpose or to violate any laws in your jurisdiction
• Upload harmful code, viruses, or malware
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, harvest, or misuse data from the platform
• Impersonate another business or individual
• Publish false, misleading, or defamatory information (e.g., fake event schedules)
• Resell or redistribute TruckCmd services without permission

Payment Terms

If you subscribe to a paid plan:

• Subscription fees are billed monthly or annually based on your chosen plan. All prices are listed on our Pricing page.
• Payment is due at the start of each billing cycle. We accept major credit cards via our payment processor.
• You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period — you will retain access until then. No partial refunds are provided for unused time.
• We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing cycle.
• If payment fails, we'll attempt to charge your card again. If payment cannot be processed, your account may be downgraded or suspended.

Data Ownership and Usage

Your data belongs to you. You retain all rights to the content you create in TruckCmd (events, prep lists, inventory data, etc.).

By using TruckCmd, you grant us a limited license to:

• Store and process your data to provide the service
• Display event information you approve on Food Truck Fav so customers can find you
• Use aggregated, anonymized data to improve our products

We will never sell your data to third parties. See our Privacy Policy for details.

Service Availability

We strive to keep TruckCmd available 24/7, but we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or outages beyond our control
• Security incidents

We are not liable for any losses resulting from downtime or service interruptions.

Limitation of Liability

To the fullest extent permitted by law, TruckCmd and its operators are not liable for:

• Lost profits, revenue, or business opportunities arising from use of the service
• Errors in prep lists, scheduling conflicts, or data inaccuracies (you are responsible for verifying critical information)
• Issues arising from third-party integrations or services
• Indirect, incidental, or consequential damages of any kind, even if we were advised of the possibility

Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Termination

Either party may terminate this agreement at any time:

• You may cancel your account at any time from your account settings or by contacting support.
• We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or misuse the service.

Upon termination, your access to TruckCmd will end. You may request a data export before closing your account.

Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we'll notify you by email or through the app. Continued use of TruckCmd after changes are posted constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of [Your Jurisdiction]. Any disputes will be resolved in the courts of [Your Jurisdiction].
